Chapter 25.--ELECTIONS
Article 26a.--PRECINCT BOUNDARIES

      25-26a05.   Same; review of maps by secretary of state; approval orrejection; boundaries established by secretary of state, when.(a) The secretary of state shall promptly review all precinct mapssubmitted pursuant to K.S.A. 25-26a04 and amendments thereto for compliancewith theprovisions of this act. The secretary of state shall promptly notify theappropriate county election officer as to whether or not such precinct mapsare in compliance with the provisions of this act. Those precinct mapsdetermined not to be incompliance with this act shall be rejected and returned to the appropriatecounty election officer with a written statement of noncompliance settingforth those instances where the map is in default. The appropriate countyor city officials shall be notified forthwith of the rejection by thecounty election officer and shall make the required adjustments andresubmit the corrected precinct map or maps within 30 days after receivingnotice of noncompliance. Notwithstanding other law to the contrary,changes in precinct boundaries shall not be effective and shall not be usedfor the conduct of any election until the secretary of state has determinedthe precinct maps are in compliance with the provisions of this act.

      (b)   If the initial or corrected precinct maps as required in this actare not filed by the deadlines set forth in this act, the secretary ofstate is hereby authorized and required to establish where necessaryappropriate precinct boundaries in compliance with the provisions of thisact, notwithstanding other law to the contrary providing orestablishing authority for any county or city official to establish precinctboundaries. The secretary of state will notify the appropriate countyelection officer of any precincts established under the provisions of thissubsection, and the county election officer immediately shall notify theappropriate city or county officials who shall forthwith adopt as theofficial precincts those precincts established by the secretary of state.
