Chapter 25.--ELECTIONS
Article 33.--PARTY AFFILIATION OF VOTERS

      25-3301.   Eligibility to vote, partisan primaries; partyaffiliation list for voting areas and advance voting ballot, application;declaration of affiliation at polls;receipt only of ballot of voter's party; preservation of affiliationstatements.(a) Each registered voter of this state who has declared a partyaffiliation as provided in this section or in K.S.A. 25-3304, andamendments thereto, shall be entitled to vote at every partisan primaryelection.

      (b)   The county election officer shall prepare for each voting placeat each partisan primary election a party affiliation list, dulycertified by such officer, which clearly indicates the party affiliationof each registered voter in the voting area who has declared a partyaffiliation. The registration book prepared for a voting place pursuantto K.S.A. 25-2318, and amendments thereto, may be used as such list,butno registration book prepared for use at a voting place in an electionother than a partisan primary election or an election held at the sametime as a partisan primary election shall indicate in any manner theparty affiliation of any voter. Such list shall be delivered by thesupervising judge to the voting place before the opening of the polls.

      (c)   The party affiliation list provided for by subsection (b) shallbe used to determine the party affiliation of a voter offering to voteat a partisan primary election and of a voter applying for an advance votingballot pursuant to K.S.A. 25-1122, and amendments thereto. If a voter's partyaffiliation isnotindicated on the party affiliation list, such voter shall state the voter'sparty affiliation in writing on a form prescribed by thesecretaryof state. A judge at the precinct polling place,or the county election officer or such officer's designee, shall give suchvoter a primary ballotof the voter's party affiliation, and such person thereupon shall beentitled to vote. Such a statement of party affiliation shall constitutea declaration of party affiliation, and all such signed statements shallbe returned to the county election officer, who shall cause them to berecorded on the party affiliation list.

      (d)   No voter shall be allowed to receive the ballot of any politicalparty except that with which such voter is affiliated.

      (e)   Party affiliation statements shall be preserved for fiveyears. The county election officer may dispose of the statements inthe manner approved for destruction of ballots as provided in K.S.A.25-2708, and amendments thereto.

      (f)   The county election officer shall update party affiliation listsas provided by rules and regulations of the secretary of state.
