Chapter 25.--ELECTIONS
Article 41.--ELECTION CAMPAIGN FINANCE; GENERAL

      25-4148c.   Independent expenditures by party orpolitical committees; reporting requirements.(a) Every treasurer for aparty committee orpolitical committee shall file reports of independent expenditures asprescribed by this act.Reports shall be filed with the secretary of state. Reports required by thissection shall be inadditions to any other reports required by law.

      (b) (1)   The report shall contain the name and address of each partycommittee orpoliticalcommittee which has made or contracted to be made independent expendituresin an aggregate amount orvalue in excessof $300 or more during the period commencing 11 days before a primary orgeneralelection atwhich a state or local officer is to be elected and ending at 11:59 p.m. on theWednesday preceding the date of the election. Suchreport shall contain the amount, date and purpose of each such independentexpenditure, as well as the name of the candidate whose nomination, election ordefeat is expressly advocated.Whenan independent expenditure is made by payment to an advertising agency, publicrelations firm orpolitical consultant for disbursement to vendors, the report of suchindependent expenditure shallshow in detail the name of each such vendor and the amount, date and purpose ofthe paymentsto each, as well as the name of the candidate whose nomination, election ordefeat is expressly advocated.The report shall be made on or before the close of business on the Thursdaypreceding the date of the election.

      (2)   In addition, a separate report shall be made on a daily basis forthe Thursday, Friday,Saturday and Sunday immediately preceding the election. Each daily report shallcontain the information required in paragraph (1) of this section. Each reportshall be filed by 5:00 p.m. on the next day respectively.

      (c)   Reports required by this section shall be filed by hand delivery, expressdelivery service, facsimile transmission or any electronic method authorized bythe secretary of state.

      (d) (1)   "Expenditure" shall have the meaning ascribed to it in K.S.A.25-4143 andamendments thereto.

      (2)   "Independent expenditure" means an expenditure that ismade without the cooperation or consent of the candidate or agent of suchcandidate intended to be benefitedand which expressly advocates the election or defeat of aclearly identified candidate.

      (3)   "Party committee" shall have the meaning ascribed to it in K.S.A. 25-4143andamendments thereto.

      (4)   "Political committee" shall have the meaning ascribed to it in K.S.A.25-4143 andamendments thereto.

      (e)   The provisions of this section shall be part of and supplemental tothe campaignfinanceact.
