Chapter 25.--ELECTIONS
Article 41.--ELECTION CAMPAIGN FINANCE; GENERAL

      25-4166.   Reports of disposition of cases; information to accompany report;procedure for consideration of and action upon reports; ouster; impeachmentor removal, when.(a) Whenever a report is made under K.S.A. 25-4164, and therespondent is elected to a state office pursuant to a primary electionor general election to which such report applies, the commission shalltransmit a copy thereof to the supreme court, legislature or attorneygeneral on the first day of the term for which the respondent is soelected.

      (b)   If the respondent is elected to be a member of the house ofrepresentatives or senate, such commission report shall be transmittedto the house to which the respondent is elected. If the respondent iselected to an office to which impeachment applies, the commission reportshall be transmitted to the house of representatives. If the respondentis elected to a judicial office, and is not subject to impeachment, thecommission report shall be transmitted to the supreme court. If therespondent is elected to an office not heretofore mentioned in thissubsection, the commission report shall be transmitted to the attorneygeneral.

      (c)   Each commission report transmitted in accordance with thissection shall include or be accompanied by a summary of the factsrelating to the report under K.S.A. 25-4164, and shall makeappropriate reference to this section. All information, reports,transcripts and other records relating to the respondent which are orhave been in the possession of the commission shall be available to thebody to which the commission report is transmitted.

      (d)   Reports relating to respondents who are elected to thelegislature shall be considered by the house to which the respondent iselected, and such house shall impose censure or disqualification or itmay determine that neither censure or disqualification is justified.Reports relating to impeachable officers shall be considered by thehouse of representatives. Reports relating to judicial officers, exceptthose subject to impeachment, shall be considered by the supreme court.Reports relating to any officer not mentioned in thissubsection may be the basis for an ouster action brought by the attorneygeneral.
