Chapter 27.--FEDERAL JURISDICTION
Article 1.--FEDERAL PROPERTY

      27-117.   Lands acquired for flood control; distribution of lease moneys.(a) All moneys paid to the state of Kansas by the United Statesrepresenting the state's share of moneys received by the United States from theleasing of lands acquired by the United States for floodcontrol purposes, and as provided by section 7, chapter 377, of the acts ofcongress of 1941 (33 U.S.C. 701c), and similar acts, shall be paid by thestate treasurer to the treasurer of each county in which such leased landsare located to be used for the benefit of public schools,public roads andto defray a part of the expenses of county government as herein provided.The county treasurer shall divide such moneys among the schooldistricts and townships having lands located within the federal floodcontrol projects and the county on the basis of 60% thereof to theschool districts, 30% to the county and 10% to the townships. Thecounty's share shall be credited to the countygeneral fund and shall be used to defray a part of the expenses of countygovernment properly payable from such fund. Except as provided by subsection(b), the township's share shall bepayable to the townships in proportion to the land area of eachlocated within the project, and shall be used for road purposes. Incounties operating under the county unit system,all money for road purposes shall be paid to the county road fund. The schooldistrict's share shall be payable to the schooldistricts in proportion to theland area of each such district located within the project,and shall beused for school purposes. It shall be the duty of the county clerk of eachcounty immediately upon the taking effect of this act and from time to timethereafter as new lands of the county are made a part of any federal floodcontrol project and leased by the United States to certify to the directorof accounts and reports the total leased acreage of such lands in thecounty.

      (b)   In any township in which there are no roads maintained by suchtownshipin the area located within the flood control project area, the township board,pursuant to a resolution adopted by the board, may transfer a portion of itsshare of money received pursuant to subsection(a) to the governing body of any drainage district or districts locatedwithin the flood control project area in such township. The amountof money transferred to drainage districts shall be payable to the drainagedistricts in an amount equal to the proportion of land area of each drainagedistrict within the project area, andshall be used for drainage district purposes.

      (c)   The state treasurer promptly shall pay out such funds held by thetreasurer as herein provided, and such funds hereafter received by the stateshall be paid over to the counties within 60 days after the sameare received. The director of accounts and reports is authorized anddirected to draw warrants upon the state treasurer and against suchfunds upon vouchers duly itemized and verified by the director of accountsand reports, and all such funds are hereby appropriated and made availablefor the purposes stated in this section.
