Chapter 27.--FEDERAL JURISDICTION
Article 3.--SURPLUS PROPERTY OF FEDERAL AGENCIES

      27-331.   Airport authority in certain counties; powers.Upon the adoption of the provisions of this act in any county, theauthority thereby created shall have the power: (a) To adopt, alter anduse a corporate seal;

      (b)   to sue and be sued, to prosecute and to defend any action in anycourt of competent jurisdiction;

      (c)   to receive, purchase, lease, obtain option upon, acquire bycontract or grant, or otherwise acquire, and to own, maintain, operate,improve, and to sell, transfer, assign, mortgage or otherwise dispose ofproperty and to contract with the United States or any of its agencies,the state of Kansas, any political subdivision thereof or any otherperson with respect to the terms on which the authority may agree topurchase or receive property, including, but not limited to, provisionsfor the purchase of property over a period of years, for payment of thepurchase price or installments thereof in the manner and to the extentrequired, and for pledge of all revenues and income received from thesale or operation of such property after providing for administration,maintenance and operation costs, to payment of the principal of thepurchase price and interest thereon or of any bond issued by theauthority therefor;

      (d)   to enter into contracts to carry out the purposes of theauthority and to execute contracts and other instruments necessary orconvenient to the exercise of any of the powers of the authority;

      (e)   to adopt, amend and repeal bylaws, rules and regulations notinconsistent with this act governing the manner in which the powers andpurposes of the authority shall be carried out and effected;

      (f)   to select, appoint, employ, discharge or remove such officers,agents, counsel and employees as may be required to carry out and effectthe powers and purposes of the authority and to determine theirqualifications, duties and compensation;

      (g)   to borrow money and pledge, mortgage property and revenues assecurity therefor;

      (h)   to distribute equally to the city and county any funds notnecessary for the proper conduct of affairs of the authority;

      (i)   to make payments in lieu of taxes to any political or taxingsubdivision levying taxes on property within the county in which theauthority is located;

      (j)   to exercise the right of eminent domain, in the mannerprescribed in article 5 of chapter 26 of the Kansas Statutes Annotated;

      (k)   to recommend the adoption of airport hazard zones under the authorityof K.S.A. 3-701 et seq., and amendments thereto, and compatibleland-use zones in the countyin order to minimize the adverse effects of airport noise and emissionsarising from the use and operation of airport facilities. The zones recommendedby the authority shall be submitted to the planning commission for reviewand the commission shall make recommendations to the city and county inthe same manner as other zoning regulations. No zones shall be adopted untilapproved by the city and county within their respective zoning jurisdictionsin the same manner as other zoning regulations;

      (l)   to own, operate and dispose of water and sewage utility systems. Theauthority may purchase and resell water services to any person,firm or corporation within territory owned by the authority and propertybeing served on the effective date of this act. The authority maypurchase and resell sewage services to any person, firm or corporation.
