Chapter 29.--FENCES
Article 3.--PARTITION FENCES

      29-312.   Rights of party not improving land adjoining partition fence. If any person shall determine not to improve any part of his landadjoining any partition fence that may have been divided according to theprovisions of this act, and shall give six months' notice, in writing(provided such notice be served between the first day of July and the firstof October), of such determination to all the adjoining owners or occupantsof lands, he shall not be required to keep up or maintain any part of suchfence during the time his lands shall lie open and unimproved; and he maythereafter remove his portion thereof, if the owner or occupant of theadjoining land will not pay therefor as provided in the preceding section.
