Chapter 32.--WILDLIFE, PARKS AND RECREATION
Article 11.--BOATING AND WATER ACTIVITIES

      32-1103.   Applicable laws; rules and regulations.(a) The provisions of K.S.A. 32-1101 through 32-1104, 32-1110through 32-1113, 32-1119, 32-1125 through 32-1128, 32-1130 through 32-1137,32-1148 through 32-1155, 32-1166, 32-1172, 32-1173 and 32-1177 through 32-1180,and amendments thereto, and of other applicable laws of thisstate shall govern the operation, equipment, numbering and all othermatters relating thereto whenever any vessel shall be operated on thewaters of this state, or when any activity regulated by this act shall takeplace thereon, but nothing in this act shall be construed to prevent theadoption of any ordinance or regulation by any subdivision or municipalityof this state relating to waters under the control or jurisdiction of suchsubdivision or municipality, and such ordinances orregulations shall be valid and enforceable so long as and to theextent that they are not contradictory to provisions of article 11 ofchapter 32 of the Kansas Statutes Annotated and amendmentsthereto or rules and regulations adoptedthereunder. Such ordinances or regulationsshall not be adopted by such subdivision or municipality until after publicnotice by the enacting body. Following such adoption the enacting bodyshall submit the same to the secretary, setting forth the reasons whichmake such regulations necessary or appropriate, and requesting the approvalof such regulations by the secretary. If the secretary approves suchregulations they shall become operative; otherwise, such regulations shallhave no effect. Notwithstanding the foregoing provisions, the secretaryshall not regulate fees to be charged by political subdivisions ormunicipalities as to waters under their control or jurisdiction.

      (b)   The secretary is hereby authorized to adopt, in accordance withK.S.A. 32-805 and amendments thereto, rules and regulations withreference to the operation of vessels on any waters within the state.
