Chapter 32.--WILDLIFE, PARKS AND RECREATION
Article 8.--DEPARTMENT OF WILDLIFE AND PARKS

      32-842.   Acquisition of land under fish and wildlife coordinationact; notice and hearing.(a) Prior to acquiring land under a license with the United States armycorps of engineers pursuant to the fish and wildlife coordination act, thesecretary shall give notice of the proposedacquisition to the board of commissioners of every county in which such landis located. The board of county commissioners shall call and hold a publichearing on the proposed acquisition. If the land is located in two or morecounties, a joint public hearing may be held if approved by a majority ofthe boards of county commissioners of such counties. Notice of the time,date and locationof the hearing shall be published once each week for two consecutive weeksin the official county newspaper. The second publication shall be no soonerthan 10 days prior to the public hearing. At such hearing, the secretary orthe secretary's designee shall give adescription of the land proposed to be acquired and the reasons for theacquisition. After the public hearing, the secretary mayenter into the license to acquire the land.

      (b)   The provisions of this section shall not apply to land acquiredpursuant to the wildtrust program nor to licenses entered into withrespect to Hillsdale reservoir project lands.
