Chapter 32.--WILDLIFE, PARKS AND RECREATION
Article 8.--DEPARTMENT OF WILDLIFE AND PARKS

      32-860.   Same; pledge of revenues.(a) The secretary shall, by rules and regulationsadopted in accordance with K.S.A. 32-805 and amendmentsthereto, prescribe and collect reasonable rates, fees, tollsor charges for the services, facilities and commodities rendered and providedat each specific project of the department, the revenues of which have beenpledged to the payment of bonds issued under K.S.A. 32-857 through 32-864 andshall revise such rates,fees, tolls or charges from time to time whenever necessary to insure thatthe revenues to be derived therefrom shall be fully sufficient to payprincipal of and interest on such bonds. The gross revenues derived by thedepartment from the operation of any part or parts of a specific project ofthe department may be pledged to the payment of such principal andinterest. It is specifically provided that the departmentmay, on any landunder its control, erect and operate or lease cabins, hotels, lodges,restaurants and other facilities for the public and make use of therecreational facilities surrounding such improvements.

      (b)   The secretary may, in conjunction with any bonds issued for theerection, extension or improvement of any lodges, hotels, cabins,restaurants or other facilities in connection with a specific project,secure leases from competent and reliable individuals or corporations, whichleases will provide for rental incomes sufficient to meet the requirementsof principal, interest, insurance and maintenance of the property to beconstructed. The determination of the secretarythat the rental rates from any such lease are sufficient to meet therequirements of principal, interest, insurance and maintenance shall befinal and conclusive. All personal propertydeemed necessary by the secretary to equip such cabins, hotels, lodges andrestaurants may be purchased by the department through thepurchasing division of the state department of administration. The secretaryshall have the power to reject any and all bids. All revenueswhich may be received by the secretary for the use of such buildings, inwhole or in part, shall be regarded as are other revenues of the projectand shall be subject to pledge to the payment of any bonds issued inconnection therewith. Each bond shall recite in substance that such bondand the interest thereon is payable from the revenues pledged to thepayment thereof and that such bond does not constitute a debt of the stateof Kansas or of the secretary or department within the meaning of anyconstitutional or statutory limitation.

      (c)   The department may collect rates,fees, tolls or charges for the use of specific projects which shall havebeen improved by funds acquired through bond issuance and such rates, fees,tolls or charges may be pledged for the payment of bonds and interest,except that no tolls or charges shall be imposed by the secretary for theuse of highways or bridges unless constructed as a part of the bond project.
