Chapter 38.--MINORS
Article 17.--UNIFORM TRANSFERS TO MINORS ACT

      38-1706.   Transfer authorized by will or trust.(a) A personalrepresentative or trustee may make an irrevocable transfer pursuant toK.S.A. 38-1710 to a custodian for the benefit of a minor as authorized in thegoverning will or trust.

      (b)   If the testator or settlor has nominated a custodian under K.S.A. 38-1704to receive the custodial property, the transfer must be made to that person.

      (c)   If the testator or settlor has not nominated a custodian underK.S.A. 38-1704, or all persons so nominated as custodian diebefore the transferor are unable, decline, or are ineligible to serve, the personalrepresentative or the trustee, as the case may be, shall designate thecustodian from among those eligible to serve as custodian for property ofthat kind under subsection (a) of K.S.A. 38-1710.
