Article 22.--REVISED KANSAS CODE FOR CARE OF CHILDREN

      38-2233.   Filing of petition on referral by SRS orother person; filing by individual.(a) Whenever the secretary or any other person refers acase tothe county ordistrict attorney for the purpose of filing a petition alleging that a child isa child in need of care, thecounty or district attorney shall review the facts, recommendations and anyother evidence availableand determine if the circumstances warrant filing a petition.

      (b)   Any individual may file a petition alleging a child is a child in need ofcare and theindividual may be represented by the individual's own attorney in thepresentation of the case.

      (c)   When a petition is filed alleging an infant surrendered pursuant toK.S.A. 2009 Supp.38-2282, andamendments thereto, is a child in need of care, the petition shall include arequest that the court findthat reintegration is not a viable alternative. Such petition also shallinclude a request to terminatethe parental rights of the parents of such infant. An expedited hearing shallbe granted on anypetition filed pursuant to this subsection.
