Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE
Article 1.--LEGAL RESIDENCE

      39-111.   State legal residence requirements; waiver, when.No person shall be admitted to a state hospital, a state hospital andtraining center, Kansas neurological institute, an institution for theeducation of the deaf, an institution for the education of the blind, or toa state hospital or sanatorium for tuberculosis, who has not lived in thestate of Kansas at least one year continuously immediately prior toapplication for admission thereto. The residence of a minor child shallfollow and be the same as his parents: Provided, however, Thesecretary of social and rehabilitation services may waive the residencerequirement in cases where the residence cannot be ascertained, or wherethe particular circumstances of the case constitute a medical emergency sothat in his judgment a sufficient reason exists for the temporarysuspension of the residence requirement.
