Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE
Article 14.--REPORTING ABUSE, NEGLECT OR EXPLOITATION OF CERTAIN PERSONS

      39-1406.   Same; persons authorized access to relevantrecords;authority to take actions to assist residents.Any person, department or agency authorized to carry out the duties enumeratedin this act, including investigating law enforcement agencies and thelong-term care ombudsman shall have access to all relevant records. Theauthority of the secretary of social and rehabilitation services, the secretaryof health and environment, and thesecretary of aging under this act shallinclude, but not be limited to, the right to initiate or otherwise take thoseactions necessary to assure the health, safety and welfare of any resident,subject to any specific requirement for individual consent of the resident.
