Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE
Article 7.--SOCIAL WELFARE

      39-7,121.   Electronic pharmacy claims managementsystem; limitations on utilization of system.(a) The Kansas health policy authority shallestablish and implement an electronic pharmacyclaims management system in order to provide for the on-line adjudication ofclaims and for electronic prospective drug utilization review.

      (b)   The system shall provide for electronic point-of-sale review of drugtherapy using predetermined standards to screen for potential drug therapyproblems including incorrect drug dosage, adverse drug-drug interactions,drug-disease contraindications, therapeutic duplication, incorrect duration ofdrug treatment, drug-allergy interactions and clinical abuse or misuse.

      (c)   The Kansas health policy authority shall not utilize this system, or anyother system orprogram to require that a recipient has utilized or failed with a drug usageor drug therapy prior to allowing the recipient to receive the product ortherapy recommended by the recipient's physician.
