Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE Article 9.--ADULT CARE HOMES

39-926a. Limitation on number of persons licensed to operate adult carehome; application of section; section supplemental to adult care home licensure act.(a) Except as otherwise provided in this section, no more than three differentpersons shall be licensed to operate any one adult care home under the adultcare home licensure act, and no license to operate any one adult care homeshall be issued under that act to more than three different persons. Theprovisions of this section shall not apply to any license to operate anadult care home which is in effect on the effective date of this act andwhich is issued to more than three different persons, or the renewal ofany such license, unless subsequent to the effective date of this act threeor fewer persons operate the adult care home or the license to operate the adult care home is denied or revoked.

(b) This section shall be part of and supplemental to the adult care homelicensure act.
