Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE
Article 9.--ADULT CARE HOMES

      39-927.   Application for license; contents; application for license tooperate new intermediate nursing care home for the mentally retarded; limitations.An application for a license to operate an adult care home shall be made inwriting to the licensing agency upon forms provided by it and shall be insuch form and shall contain such information as the licensing agency shallrequire, which may include affirmative evidence of the applicant's abilityto comply with such reasonable standards and rules and regulations as areadopted under the provisions of this act. The application shall besigned by the person or persons seeking to operate an adult care home, asspecified by the licensing agency, or by a duly authorized agent of anyperson so specified. Any nonprofit corporation operating a nursing facility forthe mentally retarded which, onthe effective date of this act, includes more than one residential buildinglocated on one site or on contiguous sites may apply for a license to operate anew nursing facility for the mentallyretarded which includes more than one residential building located on one siteor on contiguous sites and may apply for one license for each residentialbuilding located on the new site, except that total resident population at anysuch location shall not exceed 75 residents.
