Chapter 40.--INSURANCE
Article 1.--INSURANCE DEPARTMENT

      40-110.   Assistants and employees;salaries; oaths; authority ofassistants; responsibility.(a) The commissioner of insurance is hereby authorized to appoint anassistant commissioner of insurance, actuaries, two specialattorneyswho shall have been regularly admitted to practice, an executive secretary,policy examiners, two field representatives, and a secretary to thecommissioner. Such appointees shall each receive an annual salary to bedetermined by the commissioner of insurance, within the limits of availableappropriations. Thecommissioner is alsoauthorized to appoint, within the provisions of the civil service law, andavailable appropriations, other employees as necessary toadminister the provisions of this act. The field representatives authorizedby this section may be empowered to conduct inquiries, investigations orto receive complaints.Such fieldrepresentatives shall not be empowered to make, or direct to be made, anexamination of the affairs and financial condition of any insurance companyin the process of organization, or applying for admission or doing businessin this state.

      (b)   The appointees authorized by this section shalltake the proper official oathand shall be in no way interested, except as policyholders, in anyinsurance company. In the absence of the commissioner of insurance theassistant commissioner shall perform the duties of the commissioner ofinsurance, but shall in all cases execute papers in the name of thecommissioner of insurance, as assistant. The commissioner ofinsurance shall be responsible for all acts of an official nature done andperformed by the commissioner's assistant or any person employed insuch office. All theappointees authorized by this section shall hold their office at the willand pleasure of the commissioner of insurance.
