Chapter 40.--INSURANCE
Article 12a.--MUTUAL INSURANCE COMPANIES ORGANIZED TO PROVIDE HEALTH CARE PROVIDER LIABILITY INSURANCE

      40-12a01.   Definitions.As used in this act: (a) "Health care provider" meansany person licensed to practice any branch of the healingarts by the board of healingarts or any hospital licensed under the provisions of K.S.A. 65-425 etseq., and amendments thereto, or a private psychiatric hospitalauthorizedunder K.S.A. 75-3307b andamendments thereto;

      (b)   "person" means an individual, corporation, partnership, association,joint stock company, trust, unincorporated organization or any similar entity;

      (c)   "affiliate" means a person that directly or indirectly, through oneor more intermediaries, employs, controls or is controlled by, or is undercommon control with a health care provider;

      (d)   "commissioner" means the commissioner of insurance; and

      (e)   "association" means any organization whose income is exempt fromtaxation pursuant to section 501(a) of the internal revenue code of 1986,and amendments thereto, as in effect on the effective date of this act, dueto such association's compliance with section 501(c)(6) of such code, andamendments thereto, as in effect on the effective date of this act.
