Chapter 40.--INSURANCE Article 2.--GENERAL PROVISIONS

40-2,105b. Same; insurance coverage forpsychotherapeutic drugs used for treatment of mental illness.On and after January 1, 2002, any group health insurancepolicy, nonprofit medical and hospital service corporation contract, fraternalbenefit society, health maintenance organization, municipal group funded pooland state employee benefit program which provides coverage for prescriptiondrugs, other than prescription drugs administered in a hospital or physician'soffice shall provide coverage for psychotherapeutic drugs used for thetreatment of mental illness under terms and conditions no less favorable thancoverage provided for other prescription drugs.
