Chapter 40.--INSURANCE
Article 22.--UNIFORM POLICY PROVISIONS

      40-2219.   Outline of coverage to accompany policy at issuance or tobe delivered at time of application; format and contents of outline.(a) In order to provide for full and fair disclosure in the sale ofindividual accident and sickness insurance policies or subscribercontracts of a non-profit hospital, medical or dental servicecorporation, no such policy or contract shall be delivered or issued fordelivery in this state unless: (1) The outline of coverage described insubsection (b) either accompanies the policy; or (2) in all other cases,the outline of coverage described in subsection (b) is delivered to theapplicant at the time application is made and an acknowledgment ofreceipt or certificate of delivery of such outline is provided theinsurer with the application. In the event the policy is issued on abasis other than that applied for, the outline of coverage properlydescribing the policy or contract must accompany the policy or contractwhen it is delivered and clearly state that it is not the policy orcontract for which application was made.

      (b)   The commissioner shall prescribe the format and content of theoutline of coverage required by subsection (a). "Format" means style,arrangement and overall appearance, including such items as the size,color, and prominence of type and the arrangement of text and captions.Such outline of coverage shall include:

      (1)   A statement identifying the applicable category or categories ofcoverage provided by the policy or contract as prescribed in K.S.A.40-2218;

      (2)   a description of the principal benefits and coverage provided inthe policy or contract;

      (3)   a statement of the exceptions, reductions and limitationscontained in the policy or contract;

      (4)   a statement of the renewal provisions including any reservationby the insurer or non-profit hospital, medical, or dental servicecorporation of a right to change premiums;

      (5)   a statement that the outline is a summary of the policy orcontract issued or applied for and that the policy or contract should beconsulted to determine governing contractual provisions.
