Article 22.--UNIFORM POLICY PROVISIONS

      40-2228b.   Same; notice of lapse or termination;designation of person in addition to applicant to receive notice, waiver;change of designation.(a) No long-term care policy or certificate shall beissued until the insurer has received from the applicant either a writtendesignation of at least one person, in addition to the applicant, who is toreceive notice of lapse or termination of the policy or certificate fornonpayment of premium, or a written waiver dated and signed by the applicantelecting not to designate additional persons to receive such notice.

      (b)   The applicant has the right to designate at least one person who is toreceive the notice of termination, in addition to the insured. Designation ofan additional person to receive notice of lapse or termination shall notconstitute acceptance of any liability by such person for services provided tothe insured. The designation shall include the full name and home address ofsuch additional person.

      (c)   The policy or certificate shall include a waiver stated in clear termsin the case ofan applicant who elects not to designate an additional person. The waivershall state that the applicant has the right to designate at least one personother than the applicant who will receive notice of any lapse or termination ofthe long-term care policy or certificate and that the applicant elects not todesignate anadditional person to receive such notice.

      (d)   The insurer shall notify the insured of the right to change this writtendesignation, no less often than once every two years.
