Chapter 40.--INSURANCE
Article 22.--UNIFORM POLICY PROVISIONS

      40-2228e.   Same; reinstatement, conditions.Long-term care insurance policies or certificates shallinclude aprovision which provides for reinstatement of coverage, in the event of lapseif the insurer is provided proof of cognitive impairment or the loss offunctional capacity. This option shall be available to the insured ifrequested within five months after termination and shall allow for thecollection of past due premium, where appropriate. The standard of proof ofcognitive impairment or loss of functional capacity shall not be more stringentthan the benefit eligibility criteria for cognitive impairment or the loss offunctional capacity contained in the policy or certificate.
