Chapter 40.--INSURANCE
Article 22.--UNIFORM POLICY PROVISIONS

      40-2251.   Statistical plan for recording andreporting premiums and loss and expense experience by accident and healthinsurers; compilation and dissemination; Kansas health policy authority toserve as statistical agent; assessments; penalties for failure toreport.(a) The commissioner of insurance shall develop or approvestatistical plans which shall be used by each insurer in the recording andreporting of its premium, accident and sickness insurance loss and expenseexperience, in order that the experience of all insurers may be made availableat least annually in such form and detail as may be necessary to aid thecommissioner and other interested parties in determining whetherrates and rating systems utilized by insurance companies, mutual nonprofithospital and medical service corporations, health maintenance organizationsand other entities designated by the commissioner produce premiums andsubscriber charges for accident and sickness insurance coverage on Kansasresidents, employers and employees that are reasonable in relation to thebenefits provided and to identify any accident and sickness insurancebenefits or provisions that may be unduly influencing the cost. Such plansmay also provide for the recording and reporting of expense experienceitems which are specifically applicable to the state. In promulgating suchplans, the commissioner shall give due consideration to the rating systems,classification criteria and insurance and subscriber plans on file with thecommissioner and, in order that such plans may be as uniform as ispracticable among the several states, to the form of the plans and ratingsystems in other states.

      (b)   The Kansas health policyauthority, as administrator of thehealth care database, pursuant to K.S.A. 65-6804, and amendmentsthereto, shall serve as the statistical agent for the purpose of gathering,receiving and compiling the data required by the statistical plan or plansdeveloped or approved under this section. The commissionerof insurance shall make an assessment upon the reportinginsurance companies, health maintenance organizations, group self-funded pools,and other reporting entities sufficient to cover the anticipated expenses tobe incurred by the Kansas health policy authority ingathering, receiving and compiling such data.Such assessment shall be in the form of an annualfee established by the Kansas health policy authorityand charged to each reporting entity inproportion to such entity's respective shares of total healthinsurance premiums, subscriber charges and member fees received during thepreceding calendar year. Such assessments shall be paid to theKansas health policy authority andthe Kansas health policy authority shall remit suchfees to the state treasurer in accordancewith the provisions of K.S.A. 75-4215, and amendments thereto. Upon receipt ofeach such remittance, the state treasurer shall deposit theentire amount in thestate treasury to the credit of the insurance statistical plan fund.Compilations of aggregatedata gathered under thestatistical plan or plans required by this act shall be madeavailable to insurers,trade associations and other interested parties.

      (c)   The Kansas health policy authority, in writing,shall report to the commissioner ofinsurance any insurance company, health maintenance organization, groupself-funded pool, nonprofit hospital and medical service corporation and anyother reporting entity which fails to report the information required in theform, manner or time prescribed by the Kansas health policyauthority. Upon receipt of such report,the commissioner of insurance shall impose an appropriate penalty in accordancewith K.S.A. 40-2,125, and amendments thereto.
