Chapter 40.--INSURANCE
Article 24.--REGULATION OF CERTAIN TRADE PRACTICES

      40-2411.   Same; penalties for violation of cease and desist orders;hearing.Any person who violates a cease and desist order of the commissionerissued under K.S.A. 40-2407 and amendments thereto, may after noticeand hearing in accordancewith the provisions of the Kansas administrative procedure act andupon order of the commissioner be subject at the discretion of thecommissioner to any one or more of the following:

      (a)   A monetary penalty of not more than $10,000 for each and every actor violation, but not to exceed anaggregate penalty of $50,000 in any six-monthperiod; or

      (b)   suspension or revocation of such person's license;

      (c)   redress of the injury by requiring the refund of any premiumspaid by, the payment of any moneys withheld from, any consumer andappropriate public notification of the violation.
