Chapter 40.--INSURANCE
Article 25.--AUTOMOBILE CLUB SERVICES

      40-2508.   Agents of automobile clubs; registration; notice ofappointment; fee; suspension or revocation.(a) Each and every automobile club operating in this state pursuant to acertificate of authority issued hereunder shall file with the commissionera notice of appointment of a club agent by an automobile club to sellmemberships in the automobile club to the public.

      (b)   Any person desiring to engage in automobile club services,as anagent, shall first apply to the insurance commissioner in the manner hereinprescribed, for an automobile club agent registration, to authorize suchperson to engage in and transact business as an automobile services clubagent. Such applicant shall be vouched for by an official or representativeof an authorized automobile club for whom such person proposes to negotiatecontracts of automobile club memberships. The notice of appointment as clubagent shall be upon such form as the commissioner may prescribe and shallcontain the name, address, age, sex and social security number of such clubagent, and also contain proof satisfactory to the commissioner that suchapplicant is of good reputation and that such applicant has receivedtraining from theclub or is otherwise qualified in the field of automobile club servicecontracts and the laws of this state pertaining thereto. Upon terminationof any club agent's employment by an automobile club, such automobile clubshall within 30 days notify the commissionerof suchtermination.

      (c)   The application fee for registrationof club agents shall be $15 and the registration for such club agents shall berenewable on a biennial basis upon the payment of a fee of $15. Suchregistration shall expire on May 1 of the second year of theregistration period unlesssooner revoked or suspended.

      (d)   Such registration may, upon notice and hearing, be suspendedorrevoked by the commissioner if any registered club agent violates any ofthe provisions or requirements of this act.

      (e)   The procedure used at the hearing will be the same as thatprovidedfor in K.S.A. 40-242, and amendments thereto, subject to the provisionscontained in K.S.A. 40-243, and amendments thereto.
