Chapter 40.--INSURANCE
Article 32.--HEALTH MAINTENANCE ORGANIZATIONS AND MEDICARE PROVIDER ORGANIZATIONS

      40-3214.   Construction and relationshipto other laws.Except as otherwise provided in this act, health maintenanceorganizations and medicare provider organizations certificated under theprovisions of this act shall not besubject to regulation under articles 18, 19 and 19a of chapter 40 of theKansas Statutes Annotated or acts amendatory thereof or supplementalthereto.

      Solicitation of enrollees by a duly certificated health maintenanceorganization or medicare provider organization or its representatives shallnot be construed to be aviolation of any provisions of law relating to solicitation oradvertising by health professionals. A list of locations of services anda list of providerswho have current agreements with the health maintenance organization maybe made available to prospective enrollees, and shallbe made available to prospective enrollees upon request.

      Nothing in any professional practices act of any provider shall beconstrued to prohibit a provider from being employed by or undercontract to provide health care services for a health maintenanceorganization or medicare provider organization granted a certificate ofauthority under the provisions ofthis act.

      Any health maintenance organization authorized under this act shallnot be deemed to be practicing any act for which a provider is licensedand shall be exempt from laws relating to the practice of any act forwhich a provider is licensed.
