Chapter 40.--INSURANCE
Article 9.--GENERAL PROVISIONS RELATING TO FIRE INSURANCE COMPANIES

      40-972.   Same; procedure; duties ofcommissioner.(a) Any filing submitted pursuant toK.S.A. 2009 Supp.40-970, andamendmentsthereto, shallbe deemed to comply with state law unless the commissioner determines that thefiling is inadequateor unfairly discriminatory. If the commissioner determines that the filing isinadequate or unfairlydiscriminatory, the commissioner shall issue a written order specifying indetail:

      (1)   Each provision of Chapter 40 of the Kansas Statutes Annotated, and actsamendatorythereof and supplemental thereto, the insurer has violated;

      (2)   the reasons the filing is inadequate or unfairly discriminatory; and

      (3)   stating a reasonable future date on which the filing shall beconsidered no longereffective.

      (b)   If the commissioner issues an order pursuant to this section more than30 days after the date onwhich the commissioner received the rate filing, the effect of such order shallbe prospective onlyand shall not affect any contract issued or made before the effective date ofsuch order.
