Chapter 41.--INTOXICATING LIQUORS AND BEVERAGES
Article 11.--MISCELLANEOUS PROVISIONS

      41-1123.   Same; sales or destruction of certain liquors by director. All alcoholic liquor in the custody of the director through seizure byagents of alcoholic beverage control or other peace officers of the stateunder authority of a duly executed search warrant shall be held until finaldetermination of any prosecution arising under such search and seizure.Upon the final determination of such prosecution and if such alcoholicliquor is fit for human consumption the director may make application tothe court in which such alcoholic liquor was offered as evidence for anorder to sell such liquor. The court, if satisfied that such liquor soseized was being manufactured, distributed, stored, sold or used inviolation of law, shall make an order that such property be sold by thedirector at public or private sale.

      All alcoholic liquor which is unfit for human consumption may besummarily destroyed by the director.
