Chapter 41.--INTOXICATING LIQUORS AND BEVERAGES
Article 27.--CEREAL MALT BEVERAGES

      41-2729.   Flavored malt beverages.(a) This act shall be known as the flavored malt beverage act.

      (b)   "Flavored malt beverage" means a malt beverage which meets the formuladefinitions as set forth in department of the treasury, alcohol and tobacco taxand trade bureau regulations published January 3, 2005, at 27 CFR Parts 7 and25.

      (c) Notwithstanding any other provision of law, any malt product which meetsthe formula definitions of 27 CFR Parts 7 and 25 published January 3, 2005,regarding flavored malt beverages shall have imposed upon it the tax rate formalt beverages as set forth in K.S.A. 41-501, and amendments thereto, for beerand cereal malt beverage.

      (d)   Notwithstanding any other provision of law, any malt product which meetsthe definitions of 27 CFR Parts 7 and 25 published January 3, 2005, regardingflavored malt beverages shall be deemed in compliance with the labelingrequirements of this state when its labeling meets the requirements of 27 CFRParts 7 and 25 published January 3, 2005.

      (e)   Any manufacturer or brewer who intends that its products be classified asa flavored malt beverage under this act shall file with the secretary ofrevenue its registration of such products on a form prescribed by the secretaryfor such purpose, along with such other documentation as the secretary mayrequire by rules and regulations.
