Chapter 41.--INTOXICATING LIQUORS AND BEVERAGES
Article 3.--LICENSING AND RELATED PROVISIONS; CITY OPTION

      41-345.   Same; distribution; sales and taxation.(a)   Nonalcoholic malt beverages shall be distributed bydistributors, as defined by K.S.A. 41-102 and amendments thereto, pursuantto all terms and conditions of the liquor control act. The provisions ofK.S.A. 79-3817 et seq. and amendments thereto shall apply tosales and distribution of nonalcoholic malt beverages by such distributors.

      (b)   The provisions of the liquor control act, and any rules andregulations adopted thereunder for the administration of enforcementthereof, shall apply to the sale and taxation of nonalcoholic maltbeverages by retailers licensed thereunder. The provisions of K.S.A.79-4101 et seq. and amendments thereto shall apply to the sale ofnonalcoholic malt beverages at retail by such retailers.

      (c)   The provisions of the club and drinking establishment act, and anyrules and regulations adopted thereunder for the administration ofenforcement thereof, shall apply to the sale and taxation of nonalcoholicmalt beverages byclubs and drinking establishments licensed thereunder. The provisions ofK.S.A. 79-41a01 et seq. and amendments thereto shall apply to the sale ofnonalcoholic malt beverages by a club or drinking establishment.

      (d)   The provisions of K.S.A. 41-2701 et seq. and amendments thereto, andany rules and regulations adopted thereunder for the administration ofenforcement thereof, shall apply to the sale and taxation of nonalcoholicmalt beverages by retailers licensed thereunder.
