Chapter 41.--INTOXICATING LIQUORS AND BEVERAGES
Article 7.--CERTAIN PROHIBITED ACTS AND PENALTIES

      41-709.   Authorized sale or delivery by manufacturer or distributor;withdrawal of samples from warehouse; license revocation for violations.(a) No manufacturer or distributor shall sell or deliver anypackage containing alcoholic liquor manufactured or distributed bysuch manufacturer or distributor forresale, unless the person to whom such package is sold or delivered isauthorized to receive such package in accordance with the provisions ofthis act.

      (b)   Notwithstanding any other provision of the Kansas liquor control act,a distributor may withdraw from the distributor's inventory alcoholic liquor orcereal malt beverage for use as samples in the course of the business of thedistributor or at industry seminars. The withdrawal of such alcoholic liquoror cereal malt beverage shall be in accordance with rules and regulationsadopted by the secretary in accordance with K.S.A. 41-210 and amendmentsthereto and shall be subject tothe tax imposed by K.S.A. 79-4101 et seq. and amendments thereto basedon the applicable current posted bottle or case price.

      (c)   The director shallrevoke thelicense of any manufacturer or distributor who violates theprovisions of this section.
