Chapter 42.--IRRIGATION
Article 7.--DISTRICTS

      42-702.   Powers and duties of chief engineer; expenses; bond or depositfor costs.The chief engineer of the division of water resources shall have thepower to grant, reject or withhold approval of the application of theproposed irrigation district and the accompanying maps and otherinformation submitted, or may incorporate in and make a part of hisapproval and permit, such conditions, regulations and restrictions as maybe deemed by him advisable, or may require the submission of additionaldata or information if deemed pertinent or essential. If such applicationis denied and rejected the chief engineer shall state his reasons therefor.

      All expenses incurred by the chief engineer, and representatives of hisoffice under his direction, exclusive of salaries, in the investigation,inspection and consideration of application of the proposed irrigationdistrict, and its proposed project, shall be certified to and paid by thedistrict, if established, and in event that proposed district is notincorporated and established, then the certified expenses of the chiefengineer and his office force as aforesaid shall be paid by the partiessigning the application. The chief engineer shall have authority to requirebond or cash deposit for security of payment of costs, in such amount as heshall deem sufficient.
