Chapter 44.--LABOR AND INDUSTRIES
Article 15.--ATHLETE AGENTS

      44-1530.   Civil remedies.(a) An educational institution has a right of action againstanathlete agent or a former student-athlete for damages caused by a violation ofthis act.

      (b)   Damages of an educational institution under subsection (a) include lossesand expenses incurred because, as a result of the conduct of an athlete agentor former student-athlete, the educational institution was injured by aviolation of this act or was penalized, disqualified or suspended fromparticipation in athletics by a national association for the promotion andregulation of athletics, by an athletic conference or by reasonableself-imposed disciplinary action taken to mitigate sanctions likely to beimposed by such an organization.

      (c)   A right of action under this section does not accrue until theeducational institution discovers or by the exercise of reasonable diligencewould have discovered the violation by the athlete agent or formerstudent-athlete.

      (d)   Any liability of the athlete agent or the former student-athlete underthis section shall be subject to K.S.A. 60-258a, and amendments thereto.

      (e)   This act does not restrict rights, remedies or defenses of any personunder law or equity.
