Chapter 44.--LABOR AND INDUSTRIES
Article 3.--PAYMENT OF COMPENSATION

      44-343.   Same; payment of undisputed commissions; effect of acceptance.(a) In case of a dispute over the amount of earned commissions due, theprincipal shall pay, without conditions and within the 30-day periodprovided by K.S.A. 44-342,all earned commissions, or partsthereof, believed in good faith by the principal to be due, leaving to thesalesperson allremedies that the salesperson might otherwise be entitled to, includingthose provided under this act, as to any balance claimed.

      (b)   Unless payment is made by binding settlement agreement, theacceptance by a commission salesperson of a payment underthis section shall notconstitute a release as to the balance of thesalesperson's claim and any releaserequired by a principal as a condition to payment shall be in violation ofthis act and shall be null and void.
