Chapter 44.--LABOR AND INDUSTRIES
Article 5.--WORKERS COMPENSATION

      44-520a.   Claim for compensation; time limitation.(a) No proceedings for compensation shall be maintainable under theworkmen's compensation act unless a written claim for compensation shall beserved upon the employer by delivering such written claim to him or hisduly authorized agent, or by delivering such written claim to him byregistered or certified mail within two hundred (200) days after the dateof the accident, or in cases where compensation payments have beensuspended within two hundred (200) days after the date of the last paymentof compensation; or within one (1) year after the death of the injuredemployee if death results from the injury within five (5) years after thedate of such accident.

      (b)   Where recovery is denied to any person in a suit brought at law orin admiralty or under the federal employers' liability acts to recoverdamages in respect of bodily injury or death on the ground that such personwas an employee and the defendant was an employer subject to and within themeaning of the workmen's compensation act, or when recovery is denied toany person in an action brought under the provisions of the workmen'scompensation law of any other state or jurisdiction on the ground that suchperson was an employee under and subject to the provisions of the workmen'scompensation act of this state, the limitation of time prescribed insubsection (a) of this section shall begin to run only from the date oftermination or abandonment of such suit or compensation proceeding, whensuch suit or compensation proceeding is filed within two hundred (200) daysafter the date of the injury or death complained of.
