Chapter 44.--LABOR AND INDUSTRIES
Article 9.--BOILER INSPECTION

      44-917.   Conformity to law, variance; maximumallowable pressure; application of act to boilers and pressure vesselspreviously installed.(a) All new boilers and pressure vessels shallconform to the rules and regulations issued pursuant tothis statute which governnew construction and installation. If a new boiler or pressurevessel is of specialdesign or construction and the designis consistent with the spirit and safety objectives ofthis actand rules and regulations, an interestedparty may request a variance from the secretary to build and operate anonconforming boiler or pressure vessel.

      (b)   The maximum allowable working pressure of a boiler or pressurevessel carrying the American societyof mechanical engineers or other approved code symbol shall be determinedby the applicablesections of the code under which it was constructed and stamped.

      (c)   The maximum allowable working pressure of a boiler or pressurevessel which does notcarry the American society of mechanical engineers code symbol shall becomputed in accordance with the rules and regulations adopted by thesecretary.

      (d)   This act shall not be construed as in any way preventing the use,sale or reinstallation of a boiler or pressure vessel previously installedin this state, providedit has been made to conform to the rules and regulations governing existinginstallations and provided it has not been found upon inspection to be inan unsafe condition.If a previously installed boiler or pressure vessel is of special design orconstruction and the design is consistent with the spirit and safety objectivesof this act and rules and regulations, an interested party may request avariance from the secretary to use, sell, or reinstall a nonconforming boileror pressure vessel.

      (e)   This act shall not be construed to require a pressure vesselinspection of those pressure vessels moved to a different location by the sameowner.
