Chapter 44.--LABOR AND INDUSTRIES
Article 9.--BOILER INSPECTION

      44-926.   Inspection and certificate fees;disposition.(a) The owner or user of a boiler or pressure vessel required by this actto be inspectedby the chief inspector or a deputy inspector shall pay directly to thechief inspector, upon completion of inspection, inspection fees fixed bythe secretary inaccordance withthis subsection (a). The secretary shall fix annually, by rules andregulations,a schedule of fees for inspections of pressure vessels installedafter January 1, 1999, and boilers by stateinspectors and may fix different fees for inspection of boilers and pressurevessels in the various categories. Suchfees shall not exceed $500 per day for each boiler orpressure vesselinspected.

      (b)   The owner or user of a boiler or pressure vessel for which aninspectioncertificate is to be issued pursuant to subsection (b) of K.S.A. 44-924, andamendments thereto,shall pay directly to the chief inspector, before issuanceof such certificate, a certificate fee fixed by the secretary by rules andregulations of not to exceed $35.

      (c)   There is hereby created in the state treasury the boilerinspection fee fund. The chief inspector shall pay daily to thesecretary all moneys received from the feesestablished hereunder, andthe secretary shall remit all such moneys to the statetreasurer in accordance with the provisions of K.S.A. 75-4215 andamendments thereto. Upon receipt of each such remittance,the statetreasurershall deposit the entire amount in the state treasury. Twentypercentof such inspection fees shall be credited to the stategeneral fund and the balance including all of the certificate fees shall becredited to the boiler inspectionfee fund. All expenditures from the boiler inspection fee fund shall bemade in accordance with appropriation acts upon warrants of the directorof accounts and reports issued pursuant to vouchers approved by thesecretary of labor or by a person or personsdesignated by thesecretary.
