Chapter 46.--LEGISLATURE
Article 34.--2010 COMMISSION

      46-3401.   2010 commission; membership, appointment;meetings.(a) There is hereby established the 2010 commission. Thecommission shall be composed of 11 members as follows:

      (1)   One member appointed by the speaker of the house of representatives;

      (2)   one member appointed by the president of the senate;

      (3)   one member appointed by the minority leader of the house ofrepresentatives;

      (4)   one member appointed by the minority leader of the senate;

      (5)   the chairperson of the house education committee;

      (6)   the chairperson of the senate education committee;

      (7)   one member appointed jointly by the speaker of the house ofrepresentatives, the minorityleader of the house of representatives, the president of the senate and theminority leader of thesenate;

      (8)   two members appointed by the governor, of which one shall be a personlicensed by the state board of education;

      (9)   the legislative post auditor, or the designee thereof; and

      (10)   the attorney general, or the designee thereof.

      The legislative post auditor and the attorney general shall serve ex officioand shall benonvoting members of the commission.

      (b)   Except as specifically provided in paragraphs (5) and (6) of subsection(a), nothing inthis section shall be construed as requiring the appointment of legislators tothe commission. Of themembers of the commission, one member shall be from the professional andbusinesssector who isrecognized for leadership and expertise in such person's field and one membershall be a certifiedpublic accountant who is recognized for expertise in the area of schooldistrict financial operationsand who regularly conducts or has regularly conducted audits of schooldistricts.

      (c)   A member appointed by the speaker or minority leader of the house ofrepresentatives, one of the members appointed by the governor and thememberappointed pursuant to paragraph (7) of subsection (a) shall serve for terms oftwo years and until asuccessor is appointed and qualified. A member appointed by thepresident orminority leader ofthe senate and one member appointed by the governor shall servefor terms of four years and until a successor is appointed and qualified.Terms of members of thelegislature appointed to the commission shall expire at the expiration of thelegislative term for whichsuch legislator was elected. Except for vacancies created by the expiration ofa legislative term, avacancy shall be filled for the unexpired term by appointment in the mannerprescribed by thissection for the original appointment.

      (d)   Members of the commission attending regular or special meetings orsubcommittee meetings authorized by the commission, shall be paid amounts forexpenses, mileage and subsistence as provided in subsection (e) of K.S.A.75-3223, and amendments thereto. Expenses for the commission shall be part ofthe budget of the legislative coordinating council and shall be subject to thecouncil's approval.

      (e)   The members of the commission annually shall select a chairperson andvice-chairperson fromthe membership of the commission.

      (f)   The commission may meet at any time and at any place within the state onthecall of thechairperson. A quorum of the commission shall be six voting members. Allactions of the commission shallbe by motion adopted by a majority of those voting members present when thereis a quorum.

      (g)   In accordance with K.S.A. 46-1204, and amendments thereto, thelegislativecoordinating council may provide for such professional services as may berequested by the commission.

      (h)   The staff of the office of the revisor of statutes, the legislativeresearch department andthe division of legislative administrative services shall provide suchassistance as may be requestedby the commission. Upon request of the commission, the state board of educationandthe center for innovativeschool leadership established pursuant toK.S.A. 2009 Supp.76-767, andamendments thereto, shallprovide consultants and assistance when requested by the commission. Inadditionand upon the requestof the commission, the state board of education and school districts shallprovideany information andsupporting documentation related thereto.

      (i)   The commission shall cease to exist on December 31, 2010.
