Chapter 47.--LIVESTOCK AND DOMESTIC ANIMALS
Article 10.--PUBLIC LIVESTOCK MARKETS

      47-1001c.   Hearing on application for market license; issuance oflicense, when; matters considered.A hearing may be conducted by the board and the commissioner. Aftera hearing upon such application the application, conducted in accordance withthe provisions of the Kansas administrative procedure act, if the boardfinds from the evidencepresented that such public livestock market for which a market license issought would beneficially serve the livestock economy, such market licenseshall be issued by the commissioner to the applicant. In determiningwhether or not the application should be granted or denied, the board shallgive reasonable consideration to:

      (a)   The financial stability and fiduciary responsibility of theapplicant.

      (b)   Character references to be supplied in writing by at least threepersons selected by the applicant.

      (c)   The livestock industry marketing benefits to be derived from theestablishment and operation of the public livestock market proposed in theapplication.

      (d)   The adequacy of the proposed facilities to permit the performance ofproposed market services.

      (e)   The present market services elsewhere available to the trade areaproposed to be served.

      (f)   Whether the proposed public livestock market would be continuous.

      (g)   The economic feasibility of the proposed market services.
