Chapter 47.--LIVESTOCK AND DOMESTIC ANIMALS
Article 17.--PET ANIMAL ACT

      47-1712.   Rules and regulations.(a) The commissioner is hereby authorized to adopt rules and regulations forlicensees and permittees. Suchrules andregulations shall include,but not be limited to, provisions relating to: (1) Reasonabletreatment of animals in the possession, custody or care of alicensee or permittee or being transported to or fromlicensed or permitted premises;(2) a requirement that each licensee and permittee file withthecommissioner evidence that animals entering or leaving the state are freefrom any visible symptoms of communicable disease; (3) identificationof animals handled; (4) primary enclosures; (5) housingfacilities;(6) sanitation; (7)euthanasia; (8) ambient temperatures; (9)feeding; (10) watering; (11) adequate veterinary medical care; (12)inspections oflicensed or permitted premises, investigations of complaintsand training of personsconducting such inspections and investigations; and (13) arequirement thateach licensee or permittee keep and maintain, for inspection by thecommission, suchrecords as necessary to administer and enforce the provisions of theKansas pet animal act.

      (b)   The commissioner shall only adopt asrules and regulations forUnited States department of agriculture licensed animal distributors andanimal breeders, and animal distributor and animal breederpremises the rulesand regulations promulgated bythe secretary of the United States department of agriculture, cited at 9C.F.R. 3.1 through 3.12, pursuant tothe provisions of the United States public law 91-579 (7 U.S.C. § 2131 etseq.), commonly known asthe animal welfare act.

      (c)   Notwithstanding any provision in subsection (b), the commissionermay adopta requirement that each licensee and permittee file withthe commissioner evidence that animals entering or leaving the state are freefrom any visible symptoms of communicable disease.
