Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 12.--EMERGENCY INTERIM EXECUTIVE AND JUDICIAL SUCCESSION ACT

      48-1202.   Statement of policy.Because of the existing possibility of attack upon the United States ofunprecedented size and destructiveness, and in order, in the event of suchan attack, to assure continuity of government through legally constitutedleadership, authority and responsibility in offices of the government ofthe state and its political subdivisions; to provide for the effectiveoperation of governments during an emergency; and to facilitate the earlyresumption of functions temporarily suspended, it is found and declared tobe necessary to provide for additional officers who can exercise the powersand discharge the duties of governor; to provide for emergency interimsuccession to governmental offices of this state and its politicalsubdivisions in the event the incumbents thereof (and their deputies,assistants or other subordinate officers authorized, pursuant to law, toexercise all of the powers and discharge the duties of such officeshereinafter referred to as deputies) are unavailable to perform the dutiesand functions of such offices; and to provide for special emergency judgeswho can exercise the powers and discharge the duties of judicial offices inthe event regular judges are unavailable.
