Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 16.--NUCLEAR ENERGY DEVELOPMENT AND RADIATION CONTROL

      48-1620.   Licensing of low-level radioactive waste disposal facilityrequired; conditions.The hazardous waste disposal facility approval board shallreview and grant or deny final approval for each low-levelradioactive waste disposal facility license in the same manner as providedin K.S.A. 65-3433 et seq., and amendments thereto. The board shallnot approve any such license which would permit the disposal of low-levelradioactive waste below the natural level of the disposal site unless theboard, subject to legislative approval, has determined that below gradedisposal provides greater protection than above grade disposal for theenvironment and public health for the period of time for which suchlow-level radioactive waste may continue to pose a hazard to theenvironment and public health.
