Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 9.--EMERGENCY PREPAREDNESS FOR DISASTERS

      48-943.   Rules and regulations; personnel.(a) The adjutant general shall adopt rules and regulationsnecessary to administer and implement the provisions of this act. Such rulesand regulations shall include a schedule for the submission of emergencymanagement budget requests by participating state andlocal governmentagencies and for the payment and disbursement of moneys from the nuclear safetyemergency management fee fund. Commencing with the fiscalyear ending June30, 1993, the adjutant general shall prepare a budget estimate for each fiscalyear showing the total of operating expenditures and capital improvementexpenditures projected to be incurred in administering this act during thefiscal year. The budget estimate under this act shall be prepared only afterconsultation with those persons liable for the fees imposed under this act asto the costs necessary to enable state and local government agencies to performtheir responsibilities in the event of an accident at a nuclearfacility.

      (b)   Within the limitations of appropriation acts, the adjutant general isauthorized to employ appropriate personnel necessary to administer theprovisions of this act and rules and regulations adopted under this act. Allcosts incurred by the adjutant general in administering the provisions of thisact shall be paid from fees collected pursuant to this act.The adjutant general shall have the duty, in administering this act, toprevent and eliminate any duplication of services or equipment.
