Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 9.--EMERGENCY PREPAREDNESS FOR DISASTERS

      48-948.   Citation of act; purpose.(a) This act may be cited as the Kansas intrastate emergencymutualaid act.

      (b)   The purpose of this act is to create a system of intrastate mutual aidbetweenparticipating Kansas political subdivisions. Each participant of this systemrecognizes thatemergencies transcend political jurisdictional boundaries and thatintergovernmentalcoordination is essential for the protection of lives and property and for bestuse of availableassets both public and private. The system shall provide for mutual assistanceamong theparticipating political subdivisions in the prevention of, response to andrecovery from anydisaster that results in a formal state of emergency in a participatingpolitical subdivision, subjectto such participating political subdivision's criterion for a declaration. Thesystem shall providefor mutual cooperation among the participating subdivisions in conductingdisaster-relatedexercises, testing or other training activities outside actual declaredemergency periods. Thesystem shall provide a common glossary and definitions of resources based on aresourcemanagement program. This legislation provides no immunity, rights or privilegesfor anyindividual responding to a state of emergency that is not requested orauthorized, or both, torespond by a participating political subdivision. Participating politicalsubdivisions will beensuring to the fullest extent possible, eligibility for state and federaldisaster funding.
