Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 9.--EMERGENCY PREPAREDNESS FOR DISASTERS

      48-953.   Obligation of participating politicalsubdivisions to provide assistance; conditions.A participating political subdivision's obligation to provideassistance in theprevention of, response to and recovery from a locally-declaredemergency or in authorized drillsor exercises is subject to the following conditions:

      (a)   A participating political subdivision requesting assistance must haveeither declared astate of emergency in the manner specified in K.S.A. 48-932, and amendmentsthereto, orauthorized drills and exercises;

      (b)   a responding participating political subdivision may withhold resourcesto the extentnecessary to provide reasonable protection and services for its ownjurisdiction;

      (c)   emergency responders of a responding participating political subdivisionshallcontinue under the command and control of their responding jurisdiction, toinclude medicalprotocols, standard operating procedures and other protocols, but shall beunder the operationalcontrol of the appropriate officials within the incident management system ofthe participatingpolitical subdivision receiving the assistance; and

      (d)   assets and equipment of a responding participating political subdivisionshall continueunder the control of the responding political subdivision but shall be underthe operationalcontrol of the appropriate officials within the incident management system ofthe participatingpolitical subdivision receiving the assistance.
