Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 9.--EMERGENCY PREPAREDNESS FOR DISASTERS

      48-957.   Nature of activities governmental;liability.All activities performed under this act are deemed hereby to begovernmentalfunctions. For the purposes of liability, all persons responding under theoperational control ofthe requesting political subdivision are deemed to be employees of therequesting participatingpolitical subdivision. Except in cases of willful misconduct, gross negligenceor bad faith, neitherthe participating political subdivisions nor their employees shall be liablefor the death of orinjury to persons or for damage to property when complying or attempting tocomply with theKansas mutual aid system.
