Chapter 55.--OIL AND GAS
Article 14.--PRICING OF NATURAL GAS

      55-1402.   Definitions.For the purposes of this act:

      (a)   "Commission" means the state corporation commission.

      (b)   "Gas purchase contract" means any contract under which naturalgas is sold within the state of Kansas (1) to any person for resale bysuch person or (2) to any person for use by such person, but shall notbe deemed to include rate schedules, contracts or service agreementsunder which natural gas is sold (i) by a natural gas public utility asdefined in K.S.A. 66-104, either to a person for use by suchperson or to a person for resale by such person, which sale is subjectto the regulatory jurisdiction of the commission, or (ii) to theultimate consumers by other persons which are local distributioncompanies.

      (c)   "Indefinite price escalator clause" means any provision of a gaspurchase contract which provides for the establishment or adjustment ofthe price of natural gas delivered under such contract by reference toother prices for natural gas, for crude oil, or for refined petroleumproducts.

      (d)   "New well" means any well:

      (1)   The surface drilling of which began on or after February 19,1977; or

      (2)   the depth of which was increased, by means of drilling on orafter February 19, 1977, to a completion location at least one thousand(1,000) feet below the depth of the deepest completion location suchwell attained before February 19, 1977.

      (e)   "New reservoir" means any reservoir that qualifies as a newonshore reservoir under section 102 of the natural gas policy act of1978.

      (f)   "Stripper well" means any well qualifying as such under section108(b) of the natural gas policy act of 1978.

      (g)   "Price" as used herein means the price for natural gas prior tothe assessment of any production and conservation fees and taxes by thestate of Kansas.

      (h)   "Committed or dedicated to interstate commerce", when used withrespect to natural gas, means natural gas which qualifies as committedor dedicated to interstate commerce under section 2(18) of the naturalgas policy act of 1978.

      (i)   "Person" means (1) any individual, corporation (includingcooperatives), public trust or authority, partnership, joint venture orother form of business entity, or voluntary association, or (2) theUnited States, any state, or any political subdivision, agency orinstrumentality of the foregoing.
