Article 10.--NEW GOODS PUBLIC AUCTION LAW

      58-1023.   Auction sales; act inapplicable to certain sales.The provisions of this act shall not extend to the sale at publicauction of new merchandise, which was assessed personal property tax in thecounty in which the sale is to be held or is replacement stock ofmerchandise inventory which was assessed personal property tax in thecounty in which the sale is to be had, and to auction sales under thedirection of any court or court officers as may be required by law, norshall it apply to sales made to dealers by commercial travelers or sellingagents in the usual course of business, nor to a bona fide sale of goods,wares and merchandise by sample for future delivery, or by sales made bysheriffs or other public officers selling goods, wares and merchandiseaccording to law, nor to bona fide assignees or receivers appointed in thisstate selling goods, wares and merchandise for the benefit of creditors.The provisions of this act shall not apply to community sales which areheld and conducted in accordance with and subject to the provisions ofarticle 10 of chapter 47 of the Kansas Statutes Annotated and actsamendatory thereof.
