Article 14.--ACCESSIBILITY STANDARDS FOR CERTAIN DWELLINGS

      58-1405.   Same; waiver of requirements.(a) Upon application therefor, the director may waiveanyrequirement of K.S.A. 58-1402, and amendments thereto.Applications for awaiver shall be submitted to thedirector.If the director determines that such compliance isfinancially orenvironmentally impractical, the director may waivesuch requirement. Thedirector shall render a decision regarding anyapplicationsubmitted pursuant to this section within 60 days of receipt thereof.

      (b)   Unless otherwise provided by rules and regulations adopted by thedirector, proceedings to consider a waiverunder this section shall beconducted in accordance with the provisions of the Kansas administrativeprocedure act.

      (c)   Appeals from the decision of the director shallbe governedby the provisions of the act for judicial review and civil enforcement ofagency actions.
